Personally I think it's stupid. Yes it was tragic, but four years old at the time of the incident and yet they are still trying to sue them? I think it's wrong.

In America, you can get sued for pretty much everything. Also, I find it hard to believe they can prove that that incident is what lead to her death, seeing as she was 87 and it happened 3 months later :/

Think you should question the defence lawyer more than anything.

Though it's actually a good decision. If the child is competent I see no reason for them to not have a standing in law.

Also, they're seeking damages in negligence. The death is irrelevant though I love the way the BBC have hyped the story XDDD
