So if the original seller of the game is no longer selling it, meaning you must buy it from a third party (pre-owned etc). Do you deem it okay to download at this point?

Legal, it's dubious. Morally....depends on your opinion. If there's no way to legitimately buy it anymore and you want to play it then it's pretty much Abandonware and 'piracy' is your only option. I did this with System Shock 2 because it's simply not sold anywhere (the rights are in dispute, I believe some insurance company owns the rights to distribute it, it's all very strange). However the game was so good I went and paid £35 for a copy on Ebay, but copies are few and far between.

In my opinion in these particular situations people can 'toot their horn' about the moral highground and whatever, but the fact is that if you can't legitimately buy it anymore (at least not for a sane price for a second (or more) hand copy) then there's really no other choice if you want to play it.
